Description The defendants' expert witness, an epidemiologist, was deposed by the plaintiffs. He indicated that he had been asked to review and evaluate the plaintiffs' damage models in cases where the states are seeking restitution of Medicare costs. He acknowledged that smoking may be the cause of numerous diseases and is very likely to be one of the major causes of lung cancer, although causation has not been proven. He agreed that there may be a public health benefit from people quitting smoking. He discussed the reported dose-response relationship between smoking and disease. He claimed that the CPS II data cannot be applied to other populations. He believes that "synthetic estimation" or application to different subpopulations is generally inappropriate. With regard to relative-risk, he believes there has been some over-interpretation of some of the epidemiological data. The witness is not sure that it is possible to isolate smoking-attributable diseases. He explained why he deems the plaintiffs' estimates to be generally unjustified.
